Lyst survey sweepstakes official rules

NO PURCHASE IS NECESSARY TO ENTER OR WIN THE SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ODDS OF WINNING WILL DEPEND ON THE TOTAL NUMBER OF ELIGIBLE ENTRIES RECEIVED AT THE DEADLINE OF THE SWEEPSTAKES PERIOD.

Lyst Ltd of Floor 7, The Minster Building, 21 Mincing Lane, London EC3R 7AG (the "Sponsor").

PRIZE DRAW PERIOD

  • The Sponsor’s survey with sweepstakes (hereinafter referred to as the “Sweepstakes”) will run for 3 weeks opening at 12:00 a.m. (ET) on Wednesday, 21 May 2025 and close at 12:00 a.m. (ET) on Wednesday, 11 June 2025 (the “Sweepstakes Period”).

ELIGIBILITY

  • By completing the Sweepstakes, all entrants into the Sweepstakes (“Entrants”) are deemed to have accepted these Official Rules and all decisions of the Sponsor will be final and binding on all matters and all Entrants. Any entries that do not comply with the Official Rules are void.

  • The laws of the State of New York apply to and govern the Sweepstakes without regard to the conflict of laws principles thereof.

  • The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older as of the date of entry who are the direct and intended recipients of a survey invitation from Sponsor.

  • Entrants are not eligible if during the Sweepstakes Period they are (or they live with) or their immediate family member (parent, child, sibling and spouse of any of the foregoing) is an employee, representative, or agent of the Sponsor or any of their subsidiaries, licensees or affiliates (collectively, “Released Parties”).

  • Sweepstakes may only be entered in or from the fifty (50) United States or the District of Columbia. Entries originating from any other jurisdiction are not eligible for entry. All applicable federal, state and local laws and regulations apply.

THE PRIZE

  • There is one (1) prize to be won in this Sweepstakes, consisting of a $150 MyTheresa shopping voucher to be spent in the MyTheresa online store available at https://www.mytheresa.com/ (the “Prize”). The Prize will be awarded via a random drawing.

  • The Prize is subject to the MyTheresa terms and conditions available at https://www.mytheresa.com/gb/en/terms-conditions. The winner is responsible for ensuring they are aware of any expiry dates and other terms and restrictions applicable to the use of the Prize.

  • The Prize winner is solely responsible for all applicable federal, state and local taxes relating to the Prize as well as any costs and expenses not specified herein as being provided.

  • The Prize is non-exchangeable, non-transferable and no cash alternative is offered.

  • Sponsor reserves the right to substitute a prize of comparable or greater value, at its sole discretion.

  • The Prize is offered “as is” with no warranty or guarantee, either express or implied.

  • All Prize details are at Sponsor’s sole discretion.

HOW TO ENTER

  • Only one entry into the Sweepstakes per Entrant is permitted. Multiple entries from any person and entries generated by script, macro or other automated means will be void. All entries become the property of Sponsor.

  • All Entrants must complete their entry into the Sweepstakes in its entirety and entry must be received by the Sponsor by the end of the Sweepstakes Period to be eligible for the drawing. All entries received after this date will not be counted.

  • To enter, please go to the link provided to you via email and follow the directions to submit all requested information, including completion of the survey.

  • Odds of winning the Prize will depend on the number of eligible entries received.

THE DRAW AND PRIZE CLAIM PROCESS

  • The Sponsor is responsible for administering the Sweepstakes.

  • One (1) potential winner will be selected by a random drawing by Sponsor following the conclusion of the Sweepstakes Period from among all eligible entries received.

  • The potential winner will be contacted by the Sponsor by email within ten (10) business days of the end of the Sweepstakes Period. Each Entrant is responsible for monitoring for any Prize-related communications.

  • The potential winner must respond via email to the Sponsor within fourteen (14) days of being contacted by the Sponsor and confirm their full name, email address, and provide valid identification (including proof of legal residence) as requested by the Sponsor.

  • Subject to the Sponsor’s verification of eligibility and the Entrant’s compliance with these Official Rules, the Entrant will be declared the official winner of the Sweepstakes. If the potential winner does not comply with these Official Rules or is unable to be contacted or doesn’t respond to the initial notification within the specified timeframe, that potential winner will be disqualified and an alternative winner will be selected from the remaining eligible entries. Only three (3) alternate winners will be selected; after which, the Prize may go unawarded, at Sponsor’s discretion.

PUBLICITY AND DISCLOSURE OF WINNER DETAILS

  • Winner, by acceptance of Prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, in any manner, worldwide in perpetuity, without notice or review or approval.

LIABILITY

  • Released Parties are not responsible for any late, lost, stolen, misdirected, misdelivered, incomplete, illegible, or unintelligible entries, emails, or other communications of any kind; unavailable network connections; failed, incomplete, garbled, or delayed computer transmission; online failures; hardware software or other technical malfunctions or disturbances; or any other communications/system failures or circumstances affecting, disrupting or corrupting the Sweepstakes in any manner including without limitation, receipt of entries, eligibility in the Sweepstakes, winner notification, or winner response to notification; or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the Prize, or in any Sweepstakes-related materials.

  • Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes.

  • Released Parties are not responsible for injury or damage to Entrants' or to any other person's computer or device related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website.

  • Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries. If terminated, Sponsor may, at its discretion, select the potential winner from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor.

  • The Sponsor reserves the right (at its sole discretion) to disqualify any individual it finds to be attempting to undermine the entry process, the website, and/or the legitimate operation of the Sweepstakes; or otherwise fails to comply with the Official Rules; all associated entries will be void.

  • By participating in the Sweepstakes, Entrants, and Prize winner agree Released Parties will have no liability whatsoever for, and shall be held harmless by Entrants and winner against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the Prize or participation in this Sweepstakes.

  • In the event of a dispute regarding entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the Entrant and must comply with these rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses.

  • The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

DATA PROTECTION

  • The Sponsor is the data controller in respect of any personal data of entrants that is collected and processed in connection with the Sweepstakes.

  • Each entrant acknowledges that their personal data will be stored, processed, and retained in accordance with the Sponsor’s Privacy Notice, which is available at lyst.com/help/privacy-policy/.

  • In addition to the processing set out in the Sponsor’s Privacy Notice, each entrant’s personal data (including survey responses) will be processed as follows:

    • for the purposes of administering the Sweepstakes (including Prize fulfilment) and complying with the Sponsor’s regulatory obligations in relation to the operation of the Sweepstakes.
    • for research purposes, including to generate insights and carry out analytics about how entrants engage with the Survey and Lyst products and services, including the Lyst website and app.
    • in combination with information obtained by the Sponsor from other sources, including from the entrant’s use of their Lyst account and the Lyst website and app (including their order and browsing history), to enhance the entrant’s Survey responses, to enhance the effectiveness of website and app developments, and to improve the Lyst customer experience.

WINNER NOTIFICATION

  • To receive the name of the winner (first name, last initial and state of residence), send an email to: uxteam@lyst.com, by no later than 30 days after the end of the Sweepstakes.
